These terms explain the rules that apply when you access or use HiÓja.

Use HiÓja lawfully, describe offers honestly, treat people respectfully and make careful decisions before completing a transaction. The complete terms below govern your use of the service.

Accepting these terms

By accessing or using HiÓja, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the service.

You must be legally capable of entering into a binding agreement in your jurisdiction. If you use HiÓja for a business or organisation, you confirm that you have authority to bind it to these terms.

What HiÓja provides

HiÓja is a marketplace that helps users discover and connect for services, rentals, products and errands. Unless we expressly say otherwise, HiÓja is not the buyer, seller, employer, contractor, landlord, renter, courier or agent in a transaction between users.

Users decide whether to transact, agree their own price and terms, and remain responsible for checking suitability, legality, quality, identity and authority before proceeding.

Accounts and security

  • Provide accurate, current information and keep it updated.
  • Maintain the confidentiality of your password and verification codes.
  • Do not create an account for another person without authority.
  • Notify us if you believe your account has been accessed without permission.
  • You are responsible for activity carried out through your account unless applicable law provides otherwise.

Listings and user content

You retain ownership of content you submit. You grant HiÓja a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt and display that content as reasonably necessary to operate, improve and promote the marketplace.

You confirm that your content is accurate, lawful, does not infringe another person's rights and does not contain confidential information you lack permission to share. You are responsible for the goods, services, prices, claims and availability in your listings.

Prohibited activity

You may not use HiÓja to:

  • commit fraud, mislead others or impersonate another person or organisation;
  • offer unlawful, stolen, unsafe, counterfeit or rights-infringing items or services;
  • harass, threaten, exploit or discriminate against another person;
  • collect personal data without a lawful purpose or appropriate permission;
  • introduce malicious code, scrape the service at scale, bypass security or disrupt normal operation;
  • manipulate reviews, ratings, search results or marketplace activity; or
  • encourage or assist another person to violate these terms.

Transactions between users

Each user is responsible for evaluating the other party and agreeing the scope, price, payment, timing, delivery, cancellation, deposits, returns, damage and dispute terms that apply to their transaction.

HiÓja does not guarantee a user's identity, listing quality, availability, performance, payment or outcome. Ratings, verification indicators and other marketplace signals can be useful, but they are not a warranty or endorsement.

Enforcement and account action

We may review content and investigate suspected misuse. We may remove content, limit features, suspend or close accounts, or preserve and disclose information when reasonably necessary to protect users, operate the service, enforce these terms or comply with law.

Where practical and legally permitted, we will consider the context and severity of the issue before taking action.

Intellectual property

HiÓja and its branding, interface, software and original content are protected by intellectual property laws. These terms give you a limited, revocable, non-transferable right to use the service for its intended purpose. They do not transfer ownership of HiÓja property.

Availability and disclaimers

We work to provide a useful and reliable service, but HiÓja is provided on an "as available" basis. To the fullest extent permitted by law, we do not promise uninterrupted access or guarantee that all content is accurate, complete, secure or suitable for a particular purpose.

Nothing in these terms excludes warranties or rights that cannot legally be excluded.

Liability

To the fullest extent permitted by law, HiÓja is not liable for indirect, incidental, special or consequential loss, or for loss arising from user content, user conduct, third-party services or a transaction between users. Any liability that cannot be excluded is limited only to the extent permitted by applicable law.

Changes and general terms

We may update these terms as the marketplace or law changes. We will post the revised version and update the date above. Material changes may also be communicated through the service where appropriate.

If a provision is unenforceable, the remaining provisions continue to apply. A delay in enforcing a provision is not a waiver. Applicable law and any mandatory rights in your jurisdiction continue to apply.
